1. The Service
Zoguest is a white-label platform that allows hosts, property managers, and concierges to create, manage, and share digital welcome guidebooks for short-term rentals via a unique web address and QR code.
2. Eligibility and authority
You must be at least 18 years old and capable of entering into a binding contract to use the Service. If you use the Service on behalf of a business or organisation, you represent that you have authority to bind that entity to these Terms.
3. Account and credentials
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and keep it up to date. Notify us immediately of any unauthorised use of your account.
4. Acceptable use
You agree not to use the Service to:
- Violate any applicable law or regulation.
- Engage in fraud, spam, phishing, or deceptive practices.
- Infringe intellectual property or other rights of third parties.
- Distribute malware, viruses, or other harmful code.
- Probe, scan, or test the vulnerability of our systems without authorisation.
- Scrape, crawl, or extract data from the Service without authorisation.
- Reverse engineer, decompile, or attempt to discover source code.
- Resell, redistribute, or sublicense the Service without our written consent.
5. Your content
You retain ownership of any content you upload, including property descriptions, images, and guidebook information. You grant us a limited, non-exclusive licence to host, process, and display your content solely to provide the Service to you and your guests.
You represent that you have the rights necessary to upload and share your content, and that your content does not violate any law or third-party rights.
6. Intellectual property
Zoguest retains all rights, title, and interest in and to the Service, including software, designs, documentation, branding, and trademarks. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with your selected plan.
7. Payment, subscriptions, and Paddle
Some features of the Service require payment of subscription fees. Payment, billing, tax, subscription management, and refund processing are handled by our online reseller, Paddle.com.
Merchant of Record disclosure: Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Subscriptions renew automatically unless cancelled. You may cancel at any time through your billing settings. Cancellation takes effect at the end of the current billing period.
8. Refund policy

9. Service level
We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. We make reasonable efforts to keep the Service available and to correct errors.
10. Warranties disclaimer
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, to the fullest extent permitted by law. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of liability
To the fullest extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service will not exceed the amount you paid to us in the 12 months preceding the event giving rise to the claim. We will not be liable for indirect, consequential, incidental, special, or punitive damages, including loss of profits, data, or goodwill, except where liability cannot be excluded by law (e.g., fraud, death, or personal injury).
12. Indemnity
You agree to indemnify and hold harmless Zakaryae Alaoui and its affiliates from any claims, damages, liabilities, costs, or expenses arising from your content, your use of the Service, or your breach of these Terms.
13. Suspension and termination
We may suspend or terminate your access to the Service at any time, with or without notice, for material breach of these Terms, non-payment, fraud, security risk, or repeated or serious policy violations. Upon termination, your right to use the Service ceases immediately.
You may delete your account at any time. Data associated with your account may be deleted or retained in accordance with our Privacy Notice and legal obligations.
14. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which Zakaryae Alaoui operates, without regard to conflict of laws principles. Any disputes will be resolved in the competent courts of that jurisdiction.
15. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service and updating the effective date. Continued use of the Service after changes means you accept the revised Terms.
